Our Terms and Conditions

Charges  

Gelato Packages provided by The Mobile Gelato Cart are quoted and charged as  per the following;  

- Set up and pack up.  

- Travel costs include delivery within the Perth Metropolitan Area up to a 50km  radius (maximum).  

- Travel outside of this 50km area may be subject to additional charges based  on time and distance.  

- Staff service.  

- Wafer cones, cups, spoons and napkins.  

- Gelato, as per selected package.  

Payment Policy  

Terms of Payment  

- A non-refundable deposit of $300 is required to confirm the booking. This  deposit will be applied toward the final invoice as part of the total payment. 

- The final payment is due 28 days prior to the event. You will receive the final  invoice 30 days prior to the event, and the payment must be settled in full by  this time.  

- If the customer fails to fulfill the payment obligations by the due date, The  Mobile Gelato Cart reserves the right to terminate the booking, and the  deposit will not be refunded. 

Cancellation Policy   

Cancellations with Rescheduling: 

- 60 Days or More before the event: If you cancel more than 60 days prior to  the event and wish to reschedule, the booking may be transferred to a new  date (subject to availability) using the original deposit (Refer to  

Rescheduled Event policy below).  

- Less than 60 Days before the event: If you cancel within 60 days of the  event and wish to reschedule, the deposit will be forfeited and a new  deposit will be required to secure the new date (Refer to Rescheduled  Event policy below).  

- Less than 21 Days before the event: If you cancel within 21 days of the  event and wish to reschedule, the deposit will be forfeited and a new  deposit will be required to secure the new date. The final payment will be  carried forward to the new rescheduled date.  

- In all of the above rescheduling requests, the original booking may be  forfeited if a new date cannot be confirmed.  

Cancellations with No Rescheduling:  

- 21 Days or More before the event: If you cancel your booking 21 days or  more prior to the event with no intention of rescheduling, your deposit will  be forfeited. However, at our sole discretion, a partial or full refund may be  considered if we are able to rebook the date.  

- Less than 21 Days before the event: If you cancel less than 21 days prior  to the event with no intention of rescheduling, no refund will be provided.  This is due to the limited time available to rebook your date.  

Rescheduled Event Policy  

In the event that the Customer wishes to reschedule the booking for any reason,  including due to any imposed restriction resulting from the COVID-19 Pandemic or  any other force majeure event, any rescheduling of the booking will only be effected  once confirmed in writing by The Mobile Gelato Cart and subject to the following  provisions:  

- If the Customer wishes to reschedule the date of the booking, The Mobile  Gelato Cart will make all reasonable attempts to accommodate the new  date, however is under no obligation to provide service on the new date.  This is at the sole discretion of The Mobile Gelato Cart.  

- Any rescheduled date must be within twelve (12) months of the original  booked date.  

- Any rescheduled booking may be adjusted and charged as per the pricing  in effect at the time of the rescheduled booking.  

- The Customer has the benefit of this clause once, and only once. 

Liability  

The Mobile Gelato Cart is not liable or responsible for any loss of life, personal injury  or damage to or loss of property suffered by the Customer, their employees,  contractors, guests, members, patrons, invitees or any other associated persons at  the event. This includes any incidents occurring at the venue, except where such  injury, loss or damage arises directly from an act or omission of The Mobile Gelato  Cart or its employees, agents or subcontractors.  

Marketing  

The Mobile Gelato Cart actively promotes its services through various media  including print, web and social networks. By booking our services, you consent to the  use of images or videos captured at your event for marketing purposes, unless you  explicitly request otherwise in writing prior to the event.  

Acceptance of Terms and Conditions  

By making a booking with The Mobile Gelato cart, the Customer acknowledges that  they have read, understood and agreed to these Terms and Conditions. This  acceptance is effective immediately upon receipt of the booking confirmation.
